It appears that Subliminal Club has potentially reached a new level of success, roflmao.
Yesterday, @Fire was working in support when we came across a ticket from a customer alleging a new “subliminal startup” was potentially planning to take our titles and somehow rebrand them for resale. We’ve dealt with the illegal sellers before, who will either purchase or pirate our titles and then illegally put them on sale. This one, however was different. The individual plans to create a subscription based service.
At first, we paid no mind to what was sent, as competition is going to occur and there’s nothing anyone in any industry can really do about that legally. Plus, competition is good – it brings a flame to the veins, a chance to test yourself and your ideas within the collective. But to outright steal another’s work is another thing, entirely.
After noticing that the individual’s mannerisms, speech and the information being provided within this community in which they are marketing completely matches that of myself and @Fire – including instances when the “answers” to people’s questions are lifted directly from this forum, we became concerned and got legal involved. They noted that the individual jacked my grammatically improper use of the emdash (–), which I intentionally do because it provides visual space between ideas where commas seem to fail for me.
Legal discovered that the individual is indeed a customer of Subliminal Club, has purchased A Stark Black Reality and Nouveau RICH in the past and was even inquiring about major name embedded titles in support, asking weird questions about the nature of how the name has to be entered, and something about if the name can be changed.
Again – we are very aware that our products are so effective that it could theoretically produce a competent competitor and was never worried about it, because we have access to our own products as well, lol. Our mentality was always: good luck, we welcome the challenge.
The issue really became alarming when legal signed up for the individual’s “study” that they are claiming to conduct, where the script being tested was described as:
“The subliminals used in this study will contain instructions for overall joy & happiness instructions”
We went back and looked at the individual’s purchases again, and guess what title they recently downloaded? Yep – Genesis: The Art of Happiness and Joy.
It is very obvious when considering all the evidence legal produced (which I cannot post yet, depending how this unfolds legally), what they are planning to do and why they were interested in major title name embeds. I also have no doubt that this individual is going to try to use our ideas and concepts as the foundation of their endeavor.
We’ve decided that we are not engaging in anymore silly public wars and the such – but we have more than enough video and screenshots to easily prove our point.
We’re giving that individual the choice to rectify this situation on their own. If that app releases and this turns out to be more of someone just being a copycat and we verify that our files are being resold or reskinned in any way shape or form, legal is simply going straight for the Apple Developer account. But also, if the app or its content too closely resembles our branding, our style, or concepts, or infringes upon any of our trademarks we will again resort to legal.
Look, everyone – you think you can bring something new to the subliminal industry? Do it. But don’t steal or copy us. For one thing, trying to copy us immediately shows everyone that you have no innovation or ingenuity, and from a practical standpoint you will always be BEHIND us, since we are constantly growing and moving forward. You will always be in our shadow, trying to catch up.
It is better for you to develop your own ideas and approach to subliminal audio and then testing THAT within the community. But trying to assume someone else’s essence and identity is no foundation for any sustainable business.
People can say what they want about Subliminal Club, but we are unique from everyone else. We do our own thing and we leave everyone else alone unless they pull a stunt like this.
Also, to that individual – the community in which you are marketing your app has been abused and manipulated by the “paid subliminal community” so many times that they are hyper-sensitive to these issues, and I don’t blame them. People go there trying to treat them like prey, or just a source of potential money rather than human beings trying to improve their lives.
They deserve their community of people working together to develop subliminal audio in an open source manner, hence why we’ve ALWAYS kept to our own forums and we have decided not to market there at all. Whatever you’re planning, that community is not going to be welcoming when (because with this plot, it’s only a matter of WHEN) they find out that they are once again being lied to by someone.
More updates as this proceeds, but business as usual for now. Except for one thing. For obvious reasons, we’re going to have to put a hold to the idea of single module customs. Q-Programmer has been asked to upgrade our watermarks and assist me in the creation of the ZPU masks to further prevent this type of situation from happening.
